Familiarize yourself with the following:
This End User License Agreement ("EULA") is a legal agreement between you ("Personal or Corporate") and Sichan's Technology for software owned by Sichan's Technology, its affiliates, third-party suppliers and licensees and to which this EULA is enclosed. For the purposes of this EULA, "software" means the machine-readable instructions used by the processor to perform certain operations. Licensee acknowledges that he agrees to the terms of this EULA by using the Software. Licensee shall not use the Software unless it accepts these provisions.

1. Licensing.
Sichan's Technology grants Licensee the following rights in compliance with all the terms and conditions of this EULA: For software supplied with the Sichan's Technology hardware, Sichan's Technology grants Licensee a non-exclusive license to support the operation of the relevant Sichan's Technology hardware for the duration of this EULA's applicable subscription (defined below). Licensee has no right to use the software supplied with the Sichan's Technology hardware to support hardware other than the Sichan's Technology product. Licensee may install only a single copy of installable software on a single hard disk or other device repository for a single printer, computer, workstation, terminal, controller, access point or other digital electronic device ("electronic device") to the extent that device-agnostic software is provided to Licensee. If only a single copy of the software is in use, the software can be accessed and used as installed on that electronic device. Licensee may install, use, access, display, and execute only a number of copies of the Software granted during the subscription period or under a contract with other Sichan's Technology. Licensee is eligible for updates (if applicable) and operational technical support provided by Sichan's Technology during the subscription period (excluding implementation, integration, or deployment support). Certain items in the software may be subject to open source licenses. The terms of the open source license may override some of the terms of this EULA. Sichan's Technology provides the applicable open source licenses in the Legal Notice README File and/or System Reference Guide provided with the device or in the Command Line Interface Reference Guide related to a particular Sichan's Technology software or product.

1.1 Authorized users.
The license granted here is subject to the condition that the maximum number of users authorized to access and use the software alone or simultaneously must match the number of user licenses available through a Sichan's Technology channel partner company or Sichan's Technology. Licensee may purchase additional user licenses at any time at any time at the expense of the Sichan's Technology Channel Partner or Sichan's Technology.

1.2 Software transfer.
The rights to this EULA and any software or update granted herein may be transferred to a third party at the time of support or sale of the device with which the Software is enclosed during the subscription period. In such cases, the entire Software (including all components, media and print materials, upgrades and this EULA) shall be transferred and Licensee may not retain a copy of the Software. Indirect transfer (e.g. consignment) is not possible. Prior to the transfer, the end user receiving the Software must accept all EULA terms and conditions. If Licensee purchases a Sichan's Technology product and licenses the Software for end-use by U.S. Government End-User, the Licensee may transfer the Software License to the U.S. Government End-User or temporary assignee: (ii) the Licensee may first obtain the terms of this Agreement with the End-User. Except in the foregoing cases, Licensee and any transferee authorized under this Clause shall not use, transfer or provide to any third party the Sichan's Technology Software and may not grant such permission to anyone.

1.3 Subscription duration and renewal.
The Software is licensed on a subscription basis on an order form ("Subscription"). The subscription period is from 1 to 22 months from the start date specified on the order form ("subscription period") (except as specified separately on the order form). If the subscription start date is not specified on the order form, it will be the start date on which Sichan's Technology delivered the software or software license key to you. Each subscription period is automatically renewed for an additional (1) year at the expiration of the initial subscription period, unless it expires earlier in accordance with Section 10. Except where one party has notified the other in writing of termination at least 30 (30) days prior to the expiration of the current period. Unless otherwise specified in the order form, the subscription renewal fee will be the rate currently specified by Sichan's Technology for the software.

2. the retention of rights and ownership.
All rights not expressly granted to Licensee in this EULA are held by Sichan's Technology and its suppliers and licensees. The software is protected by copyright and other intellectual property laws and treaties. Sichan's Technology or its suppliers or licensees have ownership, copyright and other intellectual property rights to the Software. The software is licensed and not sold. Licensee may license the Software or any part of the Software from a third licensee by Sichan's Technology, and such third licensee is the intended third beneficiary of this EULA and such third licensee, its successors and transferee may fulfill all the provisions of this EULA, and any benefit described herein shall not include any of the rights to remedy.

3. Restrictions on end-user rights.
Licensee shall not attempt to reverse-design, reverse-compile, decompose, or otherwise analyze the source code or algorithm of the Software, nor modify or deactivate the function of the Software or create a secondary work based on the Software. Licensee shall not lease, lease, provide or sublicense commercial hosting services with this software.

4. machine data
"Mechanical data" means battery management (time remaining before discharge, latency, average current), device system time, CPU processing, application usage, free RAM, number of running processes, network information (name, identifier), firmware version, hardware version device type, audio volume, LED status, tone volume, backlight level, key light, odometer count, reboot, reboot cause, total storage and availability, power cycle time allowed by the EU device. Notwithstanding the contents of this EULA, all rights and ownership of the machine data are vested in Sichan's Technology. If Licensee is deemed to have ownership of the machine data, Licensee grants Sichan's Technology limited and irrevocable non-exclusive rights and permits to use the machine data.

5. Aggregate data collection.
Licensee shall ensure that Sichan's Technology, as permitted by law,
(a) Collect, process, and use aggregate data stored by software or related to software, including (but not limited to) data generated by the device to which the software is integrated, and allow Sichan's Technology to generate anonymous and/or aggregate data records that cannot identify natural persons ("total data"),
(b) You can use such aggregated data to improve software, develop new software or services, understand industry trends, and create and publish a white paper, report, or database summarizing the above for legitimate purposes related to the Sichan's Technology business.
(c) I acknowledge and agree that aggregated data can be used to help investigate, process, and/or prevent real or potential illegal activities.

6. Location information.
which allows licensees to use software to collect location-based data from one or more client devices and track the actual location of the client devices with the collected data. Sichan's Technology is not responsible for any use or misuse of Licensee's location-based data. Licensee agrees to bear all reasonable costs and expenditures of Sichan's Technology arising from or relating to third party claims resulting from misuse of Licensee's location-based data.

7. Personal Information protection.
Sichan's Technology's Privacy Policy (REFER to: sichans.com/privacy/sichansYacht_privacy.html), which can be modified from time to time, is included as a reference in this EULA. If the end user submits personal data to Sichan's Technology regarding the use of Sichan's Technology hardware and software, The way in which Sichan's Technology collects and uses such data is regulated by Sichan's Technology's Privacy Policy in accordance with relevant laws. Sichan's Technology strives to comply with GDPR regulations to the extent that personal data is provided to Sichan's Technology. And as long as the GDPR is relevant to the end user, the GDPR appendix to Sichan's Technology (see: https://www.sichans.com/privacy/sichansYacht_privacy.html) complements the privacy policy of Sichan's Technology).

8. Software release.
During the subscription period, Sichan's Technology or its channel partner members may provide a software release announced on or after the date the Licensee obtains an initial copy of the Software. This EULA applies to all components of a release that may have been provided to Licensee on or after the date on which Licensee obtains an initial copy of the Software unless Sichan's Technology provides any other license terms with that release. If you wish to obtain software delivered through a release, Licensee must first obtain a license for software identified by Sichan's Technology as eligible for the release. Sichan's Technology recommends checking the remaining subscription period on a regular basis so that Licensee retains the right to receive an available software release. Depending on the software features, the licensee may need to access the Internet or may be subject to restrictions specified by the licensee's network or Internet provider.

9. export restrictions
Licensee acknowledges that the Software is subject to export restrictions from various countries. Licensee agrees to comply with all relevant international and domestic laws and regulations applicable to the Software, including relevant export restrictions and regulations.

10. transfer.
Licensee may not transfer any rights or obligations of Licensee under this EULA or the legal effect of the Agreement without the prior written consent of Sichan's Technology. Sichan's Technology may transfer this EULA and its rights and obligations without the consent of Licensee. Subject to the foregoing, this EULA shall remain binding and effective against the Contracting Parties and their legal representatives, successors and authorized transferee.

11. conclusion.
This EULA is effective until the end of the term. If Licensee fails to comply with the terms of this EULA, Licensee's rights under this EULA will automatically terminate without notice of Sichan's Technology. Sichan's Technology may terminate this EULA by providing Licensee with an alternative agreement for the latest release of the Software and by specifying the terms and conditions of its agreement for continued use of the Software or its latest release. Upon termination of this EULA, Licensee shall cease to use all Software and destroy any copies of any or all Software.

12. a disclaimer of guarantee
Unless otherwise provided for in an express limited written warranty, all software provided by Sichan's Technology is "as it is" and "available" without any type of Sichan's Technology warranty, express or implied. Sichan's Technology disclaims, but is not limited to, any express, implied or legal warranties, including, but not limited to, commerciality, satisfactory quality or work effort, suitability for a particular purpose, reliability or availability, accuracy, virus eradication, non-infringement, or respect for any other rights. Sichan's Technology does not guarantee that the software will not be interrupted or error-free. To the extent that the software covered in this EULA contains an emulation library, it does not cover all functions that are fully functional or emulated, it is provided "as is" at Buyer's responsibility, and all disclaimers and restrictions contained in this section apply to that emulation library. Subject to jurisdiction, exclusion or restriction of implied warranties may not be permitted, in which case the foregoing exclusion or restriction may not apply to Licensee. No oral or written advice or information provided by Sichan's Technology or its affiliates shall be deemed to alter the disclaimer of Sichan's Technology's warranty on the software or to create any type of Sichan's Technology warranty.

13. Third-party applications This software may contain or download certain third-party applications.
Sichan's Technology makes no statements about these applications. Because Sichan's Technology has no control over such applications, Licensee acknowledges and agrees that Sichan's Technology is not responsible for such applications. Licensee acknowledges and agrees that Licensee is solely responsible for the use of third-party applications and that Licensee is fully responsible for unsatisfactory quality, performance, accuracy and effort. Licensee agrees that Sichan's Technology is not directly or indirectly liable for any damage or loss of data, including, but not limited to, any damage or loss caused or alleged to have been caused or caused by, the use or reliance of such third party content, products or services available through such application. Licensee acknowledges and agrees that the use of third-party applications is governed by and subject to the terms, license agreements, privacy policies or other related agreements, and applies the third-party application provider's privacy policy (if any) to the information or personal data provided by Licensee to such third-party application providers. Sichan's Technology disclaims any responsibility for disclosure or other conduct by third-party application providers. Sichan's Technology expressly disclaims any warranty as to whether a third-party application provider captures Licensee's personal information or the use of such third-party application provider's personal information.

14. a limitation of liability
Sichan's Technology includes, but is not limited to, software or third-party applications, including, but not limited to, errors, outages, operational or transfer delays, computer viruses, failed connections, network costs, in-app purchases, or related damages. No person shall be liable for any or all other direct, indirect, special, accidental, punitive or consequential damages arising out of or in connection with the use or unavailability of such content or function. Subject to jurisdiction, exclusion or restriction of accidental or consequential damages may not be allowed, and the above exclusion or restriction may not apply to Licensee. Notwithstanding the foregoing, Sichan's Technology's total liability for any loss, damage or cause of action, including but not limited to, any contract, tort, use of the Software or any other clause of this EULA shall not exceed the fair market price of the Software or the amount specially paid by the Buyer for the Software. The foregoing restrictions, exclusions and disclaimers (including Sections 11, 12, 13, 14 and 18) shall apply to the maximum extent permitted by the relevant legislation, even if the required purpose is not achieved by the specific measures.

15. a restraining order.
Licensee acknowledges that Sichan's Technology does not take appropriate remedies for money or damages in the event of a breach of the terms of this EULA. Sichan's Technology reserves the right to obtain a restraining order from the competent court on request for such a breach without depositing a book. The right of Sichan's Technology to obtain a restraining order remedy does not limit the right to request additional restraints.

16. Amendments.
Amendments to this EULA shall be binding only if they are in writing and signed by one of the delegating agents requested to execute the amendments. You agree that you will be subject to the updated provisions if you continue to use the Software after the updated EULA modification.

17. US Government End User Rights Restrictions.
This provision applies only to end users of US information. This software is a "commercial item" as defined in 48 C.F.R. Part 2.101 and is configured as a software "for 48 C.F.R. Part 252.227-7014(a)(1) and 48 C.F.R. Part 252.227-7014(a)(5) respectively, and as a software "for 48 C.F.R. Part 12.212" and 48.F.R.R.227.202" computers. The Software complies with the terms and conditions of 48 C.F.R. Part 12.212, 48 C.F.R. Part 252.227-7015, 48 C.F.R. Part 227.7202-4, 48 C.F.R. Part 52.227-19 and other provisions of the United States Federal Regulations respectively, and (a) only commercial items and (b) distributed to any other licensee.

18. relevant laws.
This EULA is governed by the courts of the Republic of Korea regardless of any conflict of laws and regulations. This EULA is provided in Korean and English, but there may be a misunderstanding of mistranslation due to the translator, so all conditions take precedence over Korean. This EULA is not governed by the United Nations Convention on the Sale of International Movables and is expressly excluded from its scope.
